If you're an ass, Sue someone!

The amount of lawsuits in this country is completely obsurd. I'm not saying anything you don't know already, and the amount of writing that one could do simply on litigious lawsuits is more than anyone cares to read about. What I will do, though, is point out one recent lawsuit that tickled my fancy.

Microsoft sued over alleged Xbox 360 glitch

A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony and Nintendo that it sold a "defectively designed" product.

Now, anyone who was lucky enough to get their hands on an Xbox 360 has seen and knows about the infamous Power Supply Unit (PSU). Basically, its about the same size as the original Xbox. Now, this thing, this PSU, gets VERY hot. Thats it's POINT! The "defective" rate of this unit is about 3-4%. And I guarantee that the reason people are having overheating issues (the 3-4%) is because they burried this thing under 500 lbs. of wire and cable, behind their entertainment unit, shoved against the wall, sitting on very thick shag carpeting.

I hope this douche wastes 1000's and 1000's and 1000's of dollars, or gets fined for wasting a judges time.

    these are hardware problems...similar to any kind of manufacturing like cars to homes. Apparently if you had a defective car, then that's okay for you, right?

  • While I don't feel the impetus to sue Microsoft over this issue, I will note that it is somewhat unfair to characterise this is a "user issue" (i.e., "probably buried under 500 lbs of wire, on shag carpet, etc."). I just got a 360 and pride myself on taking excellent care of my electronics, as well as properly situating them to receive the appropriate ventilation. My unit is sitting with 8 inches of space above and below, no wires touching it (other than those plugged into the back), on top of a grated metal shelf ... and my unit STILL FREEZES. Go on your anti-law suit diatribe if you will, but get your issues straight before trying to impose your retarded point of view on others.

  • Agreed with most of your points; however, from a purely marketing perspective, it should be required that if a manufacturer of a consumer product is going to sell you a product that contains a required component that is almost half the lead product's size (and godawful ugly to boot), then the manufacturer should be required to display the beastly thing on its packaging.

    That way, you'll at least know what you're getting before you get it home.

    And I guarantee you're wrong. One user with the problem specifically stated he propped his 360 in an open window so freezing air would keep it extra cool. The result? The 360 still hung within 30 minutes.

  • With any product there are going to be problems especially when they are newly released. Car companies are the same way...never by a new model just introduced. I am sure Microsoft is willing to rectify any issues that might pop up and they are going to stand behind their warranty...if they didn't then he might have grounds to sue. There are too many dumb asses that don't care to work but want to get rich quick and this dumb ass is one of them.

  • Great bl0g m8. That said, yes... I agree that this is quite possibly a frivilous lawsuit, although I'd be quite interested to hear what actions this person took beforehand to possibly get a replacement.

    The XB360 froze? Big deal... get another one. Caught your house on fire & burnt it to the ground? Sue their ass off!

    I totally agree... people can be so fukkin' stupid! Loss of life, or livelyhood is a reason to sue. Loss of entertainment time? Come on!

  • Hey-- regarding the xbox thing from way back when.. my husband got the xbox about a week after it came out, and he BABIED that thing from the start. It has it's own little shelf on the entertainment center, it's definitely not buried under tons of wires or anything else for that matter- it's on DISPLAY for crying out loud... it gets used MAYBE 3 hours a week, if that, and all of a sudden, it just locked up during Need for Speed underground version 1 million or something, and it won't work. The red light comes on instead of the green in the front when you go to turn it on. We called Microsoft's xbox support line.. they had us unplug it and plug it back in- just like restarting a computer running microsoft windows when it freezes up for no apparent reason. Well, it worked to fix the problem, for all of 8 minutes. The same thing happened- red light came on, you can't do a thing with it. We called microsoft back, they said we could ship our xbox to them at our cost, pay them $129 over the phone (right now, before we even know if they can fix it!) and within 2 weeks, they'll have it back to us.

    So while I agree that people sue for everything and anything these days, I also agree with the guy with the class action suit that Microsoft did not do enough testing on these systems because they wanted to release their product first. With the kind of money Microsoft has, there is no reason they should be releasing products that consistently don't work, and then CHARGE the consumers to have them shipped out to fix them, when the system has had no damage, and has hardly even been used.
